Sabahan again fails in bid for judicial review of HERALD seizure

KOTA KINABALU: The Court of Appeal on Mar 19 rejected an appeal against the dismissal of a Sabahan’s application to review the Home Ministry’s confiscation of 2,000 copies of the HERALD in October 2013.
Judge Datuk Hamid Sultan, in dismissing the case, said that the seizure was merely academic in nature and did not infringe on constitutional rights.
“The appellant should seek a declaration by way of writ where constitutional rights are affected.
“The judicial review is too constrictive,” he said before dismissing the case.
In January last year, political activist Daniel John Jambun filed for a judicial review against the seizure, citing a breach of the Federal Constitution and the 10-point solution by Putrajaya to allow Christian materials to be imported to Sabah. -- The Malaysian Insider
